Appeals Court Sides Mostly With NTP

The US Court of Appeals upheld most of the decisions reached by the district court in the patent infringement lawsuit brought against RIM by NTP. The appeals court did, however, say the lower court erred in one area key to several infringement claims. In light of this error the appeals court set aside the monetary damages and an injunction against US sales of BlackBerry, and told the district court to reconsider certain parts of the case and the accompanying penalties.

Iin a brief statement RIM emphasized that the US Patent & Trademark Office is continuing its review of NTP’s patents.

Stay tuned; this ain’t over by a long shot. It will, however, delay again introduction of non-RIM devices which have BlackBerry software installed on them.
